Employer Rights and Responsibilities During a Claim

What employers must do to keep workers safe—and support recovery if injury happens.

As an employer, if a worker is hurt on the job, you play an important role in their recovery—and if time off is needed—their return to work. You also have rights and responsibilities during the claims process. This ensures you, your employees and WCB work together for the best outcomes.

Right to be involved in the return-to-work process

You have the right to participate in planning your worker’s return to safe and suitable duties.

Right to access claim information

You may request claim information if it affects your role in the process. WCB will provide what is relevant while protecting the worker’s privacy.

Right to appeal a decision

If you disagree with a decision that affects your workplace, you can file an appeal. Appeals must be filed within 30 days of the written decision.  

Right to participate in an appeal

If a worker appeals a claim decision, you have the right to be informed of the issues they are disputing and to participate in the appeal process.

Your responsibilities during the claims process

Nova Scotia’s Duty to Cooperate law outlines specific responsibilities for employers, workers, and WCB—ensuring that all parties work together to support a safe and timely return to work.

After a workplace injury, you are required to:

  • Report the injury to WCB
  • Contact the worker as soon as possible after the injury occurs
  • Maintain communication throughout recovery and full return to work
  • Establish a return-to-work plan
  • Attempt to provide suitable, available work that, where possible, restores the worker’s pre-injury earnings
  • Provide WCB with any requested information about return to work

During the claim, you are expected to:

  • Join meetings, case conferences, or assessments
  • Respond promptly to communication from WCB
  • Update WCB if the worker’s status or your workplace changes
  • Support approved return-to-work or recovery plans

Employers who do not meet their Duty to Cooperate obligations may face penalties or surcharges.
