Have your say: Proposed changes to how some long-term benefits are paid

We’re proposing changes to how we pay some long-term benefits and we’d like to hear from you. 

Policy 3.9.5 Commutation of Permanent Impairment Benefits sets out when we pay permanent impairment benefits (PIB) and extended earnings replacement benefits (EERB) as a lump sum. The proposed changes bring the policy in line with the Act, make our service simpler and more consistent, and give workers choice in how they receive some benefits.  

Proposed changes

We’d like your feedback on the following proposed changes to the policy:

  • Extended earnings replacement benefits will be paid regularly only. This benefit replaces lost earnings while a worker recovers. Those earnings can change as a worker recovers and returns to work, so paying workers in advance no longer aligns. 
  • Each permanent impairment benefit will be looked at on its own. Benefits rated 30% or less will be paid as a lump sum. Receiving this benefit as a lump sum can be more convenient for workers. 
  • Workers will choose for higher ratings. For permanent impairment benefits rated more than 30%, workers can choose a lump sum or regular payments. This gives workers more say in how they receive this benefit.
