Supreme Court Judgement on Martin v. WCB Alberta


In a judgement issued March 28, 2014, the Supreme Court of Canada brought clarity to the question of how provincial WCB Acts and Policy apply to federal workers covered under the Government Employees Compensation Act (GECA).

The Court found that the WCB was required to apply provincial law and policy to determine compensation for an employee governed by the GECA.  The GECA incorporates provincial workers’ compensation regimes, except where they conflict with the GECA.The Court has confirmed that the WCB must continue to apply provincial law and policy to determine the entitlement to compensation for employees governed by the GECA.

The judgement supports current WCB practice.
